Welcome to OnlyRoses Kuwait. Please read these Terms of Service carefully before using our store, website, or services. By visiting, browsing, or placing an order you agree to be bound by these Terms. If you do not agree, please do not use our services. These Terms should be read alongside our Returns & Refund Policy, Shipping, Delivery & Complaints Policy, and Privacy Policy, all of which form part of this agreement. These Terms are governed by the laws of the State of Kuwait.

1. About Us

This store and website are operated by OnlyRoses Kuwait. References to “we”, “us”, and “our” in these Terms refer to OnlyRoses Kuwait. Our services are powered by Shopify. All purchases are made directly with OnlyRoses Kuwait; Shopify is not a party to any transaction and bears no liability in connection with your purchase.

2. Eligibility

By using our services you confirm that you are of legal age to form a binding contract in the State of Kuwait (18 years of age or older), or that you are using our services with the consent and supervision of a parent or guardian. OnlyRoses Kuwait reserves the right to refuse service to anyone at any time at our discretion.

3. Our Products

OnlyRoses Kuwait offers two core product families:

• Classic Roses — fresh, custom-crafted floral arrangements made to order. Each is handcrafted and unique; minor variations from product images do not constitute a defect.
• Infinite Roses — preserved roses designed to maintain their appearance for one year or more under normal indoor conditions. They require no watering or maintenance.

We reserve the right to limit the sale of our products to any person, geographic region, or jurisdiction at our discretion. Product descriptions, images, and specifications on our website are provided in good faith but are subject to change without notice. On rare occasions, we may substitute a product of equal or higher value where the original item is unavailable.

Products are offered for personal use and gifting only. Commercial resale without our prior written consent is not permitted.

4. Prices & Payment

All prices are quoted in Kuwaiti Dinar (KWD) and are inclusive of any applicable charges unless otherwise stated. Prices are subject to change without prior notice; changes will not affect orders that have already been confirmed.

Payment is due in full at the time of ordering unless a separate written arrangement has been agreed with OnlyRoses Kuwait. We reserve the right to cancel any order where payment cannot be confirmed.

5. Orders & Contract Formation

Placing an order constitutes an offer to purchase. A binding contract is formed only when OnlyRoses Kuwait sends you an order confirmation by email, WhatsApp, or in-store receipt. We reserve the right to refuse or cancel any order, including where a pricing error has occurred, a product is unavailable, or we are unable to verify payment.

For same-day and bespoke orders, preparation may begin immediately upon confirmation. Once preparation has started, cancellation may not be possible. Please contact us as early as possible if you need to amend or cancel.

6. Shipping & Delivery

All deliveries are made by our in-house team. Risk of loss or damage transfers to you upon delivery to the address you specified or upon collection from our store. Delivery fees are additional to the product price and are quoted in KWD.

7. Returns & Refunds

Classic Roses are perishable and custom-made; they cannot be returned or refunded once collected or delivered, except where damaged or incorrect on arrival. Infinite Roses may be exchanged within 7 days of purchase, subject to conditions.

Full details are set out in our Returns & Refund Policy. Nothing in these Terms limits your statutory rights as a consumer under Kuwaiti law.

8. Intellectual Property

All content on this website and in our materials — including text, photographs, graphics, logos, product names, and trade marks — is the property of OnlyRoses Kuwait or its licensors and is protected under Kuwaiti and international intellectual property law.

You may view and print content for personal, non-commercial use only. You may not reproduce, distribute, modify, or commercially exploit any content without our prior written consent. Any feedback, suggestions, or ideas you submit to us may be used by OnlyRoses Kuwait without restriction or compensation.

OnlyRoses is a trade mark. Unauthorised use is strictly prohibited.

9. Third-Party Links & Services

Our website may contain links to third-party websites or services, including Shopify-powered tools and payment processors. These links are provided for convenience only. OnlyRoses Kuwait has no control over third-party content or practices and accepts no responsibility for them. We are not liable for any loss or damage arising from your use of third-party sites or services.

10. Disclaimer & Limitation of Liability

Our services are provided “as is”. To the fullest extent permitted by Kuwaiti law, OnlyRoses Kuwait disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We shall not be liable for any indirect, incidental, special, or consequential losses arising from your use of our services, except where such liability cannot be excluded by law. Our total liability to you in connection with any order shall not exceed the amount paid by you for that order.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Kuwait, including the Commercial Law No. 68 of 1980, Consumer Protection Law No. 39 of 2014, and the Electronic Transactions Law No. 20 of 2014. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Kuwait.

If you are unable to resolve a complaint with us directly, you may escalate the matter to the Consumer Protection Department, Ministry of Commerce and Industry of Kuwait.

12. Changes to These Terms

OnlyRoses Kuwait reserves the right to update or amend these Terms at any time. The most current version will always be published on this page with the date of last update. Your continued use of our services following any change constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
